At Etrity, we are deeply committed to protecting the intellectual property rights of artists, creators, and businesses. If you believe your work has been used on our website without proper authorization, we’re here to help you address your concerns quickly and fairly.

How to Report an Infringement

If you are the owner of intellectual property rights, or an authorized agent acting on their behalf, please send us an email with the following complete information so we can process your claim:

  1. Your Contact Information:
    • Full Name or Company Name
    • Email Address and Phone Number
    • Physical Address
  2. Detailed Description of the Infringed Work:
    • Provide a clear description of your copyrighted work, trademark, or other intellectual property that you believe has been used without permission.
  3. Location of the Infringing Content:
    • Specify the exact URL(s) on Etrity where the allegedly infringing material appears.
  4. Good Faith & Accuracy Statements:
    • Please include these two statements in your email:
      • “I have a good faith belief that the use of the material in the manner complained of is not authorized by the intellectual property owner, its agent, or the law.”
      • “I declare under penalty of perjury that the information in this complaint is accurate and that I am the owner, or authorized to act on behalf of the owner, of the intellectual property rights involved.”
  5. Signature:
    • Your electronic or physical signature.

What Happens After You File a Claim

Once we receive a complete and valid notice from you, we will:

  • Temporarily disable or remove the allegedly infringing content while we conduct our review.
  • Contact the content uploader to gather more information or provide them an opportunity to submit a counter-notice.
  • If your claim is verified and found valid, the content will remain removed, and future uploads of the same material may be blocked.
  • If the claim is invalid or incomplete, we’ll notify you and may request additional information.

Submitting a Counter-Notice (For Content Uploaders)

If you believe your content was wrongly removed due to a false claim, you may submit a counter-notice. This notice must include:

  • Your full name and contact information.
  • Identification of the material that was removed, including its URL.
  • A statement under penalty of perjury that you believe the content was taken down in error.
  • Consent to the jurisdiction of a federal court (or equivalent local court) and acceptance of service of process from the original complainant.
  • Your physical or electronic signature.

We will then forward your counter-notice to the original complainant. If they do not file legal action within 14 business days, the content may be restored.

Our IP Related Policies

  • Zero Tolerance for Abuse: Filing false or fraudulent claims is illegal and can lead to liability for damages and legal fees.
